Alderney Gambling Control Commission
Alderney Gambling Control Commission (AGCC) is an independent and non-political commission established in year 2000. The commission governs eGambling in the States of Alderney. The main purpose of AGCC is to ensure fairness and maintain the integrity of internet gambling in the states of Alderney. AGCC makes sure that the highest international standards are met with its supervisory and regulatory approach.
Among the British Channel islands, Alderney is the third largest. It has long been considered a leading finance offshore centre. In the past few years, the jurisdiction has earned a reputation of being a centre of excellence for e-commerce. Alderney has an independent legislative system. The regulation of Alderney and Gurnsey finance industry is supervised by the Guerney Financial Services Commission. AGCC regulates land based as well as online gambling operations in the region. A licence for operation of an online gambling site or network from AGCC is accepted and recognised by the UK and the European Union, which means that English and European players may play online at AGCC approved sites.
Acquiring an Alderney Gambling Control Commission (AGCC) License
Licenses issues by the commission are divided in to two broad categories. Category one covers business to consumer (B2C) licenses. It includes player fund management, registration and authentication of players as well as proper organization of gambling operations. Businesses to business (B2B) licenses are included under Category two. These enable the operational management of gaming site. To get a license, operators are required to submit accurately filled application forms, all supportive documents, related deposits and deposit for the expenses likely to be incurred by AGCC during the process of approval.
Based on the type of services that the operators plan to offer, they may have to apply for either one or both the categories of licenses. For a short-term use, operators can apply for a temporary license, while third party suppliers need a software supplier’s certificate. An Alderney Gambling Control Commission license offers many benefits. Operators with AGCC license who meet the criteria for tax-exempt status are required to pay only a reasonable fixed yearly fee instead of income tax. Moreover, sales tax, VAT and other duties are not applicable to gaming operators.
The Cost of an Alderney Gambling Control Commission (AGCC) License
Depending on the type of license, the costs can vary. For a license belonging to Category one, if an operator has no prior gaming business in the region, ₤35,000 is the license fee for the first year. For businesses with net gaming income below ₤1 million, the renewal fee is ₤35,000. The fee for operators with net gaming yield between ₤1 million and ₤5 million is ₤70,000. Operators with net yield between ₤5 million and ₤7.5 million are charged a fee of ₤100,000, while those with yield exceeding ₤7.5 million are required to pay ₤140,000.
Only an Alderney organization can obtain a Category two license as per the Gambling Ordinance. A Category two license holder can operate more than one gaming platform, can operate gaming on the behalf of other operators or Category one licensees and can offer multiple forms of gaming. A Category two license costs a yearly fee of ₤35,000. A temporary license, that allows a firm to operate as a Category one as well as a Category two licensee costs a yearly fee of ₤10,000. Such an operator will also have to pay yearly fee of ₤35,000 for foreign gambling associate certificate and 10,000 for core services associate certificate.
Additional guidelines set up by AGCC
Whilst we would love to say that the Alderney Gambling Control Commission has safeguards in place to ensure safety of player funds, we simply cannot say such a thing. Although AGCC does require that their licensed operators maintain positive debt ratios on their books (more assets on hand than liabilities), but this is not to say that player’s money is 100% safe due to this requirement.
However, the AGCC does “suggest” (note the word suggest does not mean require, thus it is not a law) that their member licensed operators provide a status update to their players in regards to deposited player funds. AGCC Guidelines suggest that the casino/bingo site should tell their players whether the deposited money is segregated from the other business operating accounts (read: separate from the account that pays the bills), not segregated (read: not separated from bill paying accounts), or segregated and protected. Clearly, the segregated and protected accounts are what any prudent player would be looking for from a bingo site, as this means that players’ funds are most likely safe if the operator fails as a business.
